The Massachusetts Supreme Judicial Court ruled that Fanny Hill is not obscene

Any person interested in the sale, loan or distribution of said book may appear and file answer on or before the return day named in the notice or within such further time as the court may allow, and may claim a right to trial by jury on the issue. Section 28E. If no person appears and answers within the time allowed, the court may at once upon motion of the petitioner or of its own motion, no reason to the contrary appear, and if the court finds that the book is obscene, indecent or impure, it may make an adjudication.

Section 28F. If an appearance is entered and answer is filed, the case will be set down for a quick hearing, but a default and order will be entered against all the people who have not appeared and answered. The court may receive testimony from experts and receive evidence as to the literary, cultural or educational character of the book, as well as the manner and form of its publication, advertisement, and distribution.

The court can make an adjudication in the manner provided in section twenty-eight E. Section 28G. The provisions of section twenty-eight C do not allow for objection if a mere judgment, order or decree is sought, and no relief can be claimed if the defendants know the facts.

The justices of the Massachusetts Supreme Judicial Court found that Fanny Hill is obscene. 349 Mass. 69, 206 N. E. 2d 403. Four of the seven judges of the New York Court of Appeals think it's not obscene.
